Data Privacy Statement for Digital Signatures at ORF

The Austrian Broadcasting Corporation (Würzburggasse 30, 1136 Vienna, reachable under kundendienst@orf.at) uses digital signatures both for the digitization of the in-house paraph run and for the all-round legally binding digital signing of contracts and agreements. In this context, personal data is processed, whereby
  • the basic interest in the data application is that contracts or agreements can be concluded electronically, whereby the in-house paraph run is also to be taken into account and implemented, whereby Art 6 para 1 lit f) DSGVO (legitimate interest) is fulfilled;
  • the individual signatures and the associated data processing are necessary for the performance of a contract or for the implementation of pre-contractual measures (Art 6 para 1 lit b) DSGVO).
In this context, the following data are processed:
Employees:
  • User ID
  • First name / Last name
  • e-mail address
  • Digital signature (if the digital signature is used) or data belonging to the signature
  • Paraph character
External:
  • First name / Last name
  • E-mail or telephone number
  • Digital signature (if the digital signature is used) or data belonging to the signature
  • Paraph character

Data storage

This data will be stored until the termination of the respective contract or agreement or until the expiry of the statutory retention periods (7 years in accordance with tax law or company law provisions; 15 years in accordance with ORF-G § 31 (2) ORF-G in conjunction with § 40 (6) ORF-G), and beyond that until the termination of any legal disputes in which the documents are required as evidence.
After expiry of the above-mentioned periods, your data will be deleted.

Data transmission

The data may be transmitted to the following bodies:
  • competent administrative authorities, in particular tax office
  • Bundesanstalt „Statistik Österreich“ for the compilation of the legally required (official) statistics
  • Auditors and other bodies to which the company is subject (e.g., the Austrian Court of Audit, audits pursuant to the ORF Act)
  • Legal representation, collection agencies and courts, insofar as this is necessary for legal defense or enforcement.

Contract Processors

ORF uses contract processors to provide IT services. It also uses a processor to provide the „Digital Signature“ service.

Your rights as a data subject of data processing

  • Pursuant to Art 15 DSGVO, you have the right to request confirmation as to whether personal data is being processed by the controller and the right to obtain information about this data.
  • Pursuant to Art 16 DSGVO, you have the right to request without undue delay the rectification of inaccurate data concerning you and/or the completion of incomplete personal data. The correction will be communicated by us to all recipients of your data pursuant to Art 19 DSGVO, if applicable.
  • According to Art 17 DSGVO, you have the right to have your personal data deleted. The deletion will be communicated by us to all recipients of your data according to Art 19 DSGVO, if applicable.
  • According to Art 18 you have the right to restriction of processing. The restriction of processing will be communicated by us to all recipients of your data pursuant to Art 19 DSGVO, if applicable.
  • According to Art 21 DSGVO you have the right to object to data processing.
  • According to Art 20 DSGVO you have a right to data transfer.
  • Finally, you have the possibility to lodge a complaint with the Austrian Data Protection Authority (Barichgasse 40-42, 1030 Vienna; dsb@dsb.gv.at) or to seek legal remedy in court.
